[UPDATE] Obama administration files amicus brief urging top court to legalize gay marriage

The Obama administration filed an amicus brief with the U.S. Supreme Court on late Friday afternoon, urging the country's highest court to rule in favor of same-sex marriage, U.S. Justice Department spokesperson Dena Iverson said.

The 'friend of the court' brief comes more than seven weeks before the U.S. Supreme Court is set to hear oral arguments in gay marriage cases from Kentucky, Michigan, Ohio and Tennessee. The outcome of the cases will likely determine the legality of gay marriage across the nation.

Earlier this week, U.S. Attorney General Eric Holder said in an op-ed in USA Today that "the time has come" to recognize that gay and lesbian people deserve robust protection from discrimination, and that state laws banning same-sex marriage violate "the fundamental constitutional guarantee of equal protection of the law."
