United States Patent And Trademark Office Trial And Appeal Board Grants MI-16 LLC & METALAST® Trademark Owner’s Motion To Suspend And Also Denies Chemeon’s Motion To Strike

- On May 23, 2017 the United States Patent and Trademark Office ("USPTO") - Trademark Trial And Appeal Board ("TTAB") in the pending case, Chemeon Surface Technology, LLC (Petitioner) v. David M. Semas/MI-16 LLC ("Respondent") Cancellation No. 92064833; Respondent's motion to suspend was granted. All further legal proceedings before TTAB pending the final disposition of a civil action involving the parties are suspended. Petitioner Chemeon's motion to strike was denied. TTAB found in view of the suspension, the Petitioner Chemeon's motion for summary judgment for cancellation of the METALAST® trademark (9 TTABVUE) would be given no further consideration.

On April 4, 2017, while the USPTO case was pending, federal bankruptcy court Judge Bruce T. Beesley ("Judge Beesley") approved the sale of the USPTO registered trademark "METALAST®" from its legal owner David M. Semas, to MI-16 LLC (United States Bankruptcy Court, District of Nevada Case No. 13-52337-BTB).
